Terms and Conditions of Kizomba Evolution
1. Scope and Acceptance
1.1. These Terms and Conditions apply to all participants, students, visitors, attendees, and users of the services, classes, workshops, bootcamps, events, communication channels, and website of Kizomba Evolution.
1.2. By registering for, attending, participating in, or making use of any service provided by Kizomba Evolution, the participant agrees to these Terms and Conditions.
1.3. These Terms apply to all activities organized by Kizomba Evolution, including but not limited to regular courses, single classes, workshops, bootcamps, socials, special events, guest teacher activities, and future activities organized under the Kizomba Evolution brand.
2. Participant Responsibilities
2.1. Participants shall follow all reasonable instructions, guidelines, and decisions of teachers, assistants, staff members, organizers, and authorized representatives of Kizomba Evolution.
2.2. Participants shall behave respectfully toward teachers, staff, volunteers, venue personnel, and fellow participants at all times.
2.3. Participants are responsible for ensuring that they are physically capable of participating in dance-related activities.
2.4. Participation in all activities is voluntary and at the participant's own responsibility and risk.
2.5. Participants remain responsible for their own personal belongings at all times.
2.6. Kizomba Evolution is not liable for loss, theft, or damage to personal property except where liability cannot legally be excluded.
3. Safety, Respect, and Community Standards
3.1. Kizomba Evolution is committed to providing a safe, respectful, welcoming, and inclusive environment.
3.2. Harassment, discrimination, intimidation, bullying, stalking, threats, unwanted physical contact, repeated inappropriate behavior, or conduct that creates an unsafe environment will not be tolerated.
3.3. Participants must respect personal boundaries and immediately respect a refusal to dance, participate in an exercise, or engage in physical contact.
3.4. Participants shall maintain reasonable personal hygiene appropriate for close-contact partner dancing.
3.5. Participants may not attend activities while excessively intoxicated or under the influence of substances that may negatively affect safety, behavior, or participation.
3.6. Kizomba Evolution reserves the right to refuse entry, remove, suspend, or permanently exclude any participant from classes, events, communication groups, or future registrations where this is reasonably necessary to protect safety, wellbeing, business interests, or the learning environment.
3.7. In cases of serious misconduct, removal may take effect immediately without prior warning.
3.8. Any decision regarding refunds following removal for misconduct shall be determined by Kizomba Evolution based on the circumstances and applicable law.
4. Enrollment and Participation
4.1. Registration may take place through the official website or through other methods communicated by Kizomba Evolution.
4.2. Kizomba Evolution reserves the right to refuse registrations on reasonable grounds, including capacity limitations, safety concerns, previous misconduct, or violation of these Terms.
4.3. Courses are generally offered in blocks of approximately four weeks unless otherwise communicated.
4.4. Single classes, workshops, bootcamps, and special events may be offered separately.
4.5. Participants may be permitted to join after a course has started where this has been agreed in advance by Kizomba Evolution.
4.6. Placement in a particular level or class may be determined by teachers where reasonably necessary for safety, class structure, or learning outcomes.
5. Payments
5.1. Fees must be paid using the payment methods communicated by Kizomba Evolution.
5.2. Unless otherwise agreed, payment must be completed before participation begins.
5.3. Failure to pay may result in suspension of participation until payment obligations have been fulfilled.
5.4. Discounts, promotions, referral rewards, credits, and special offers are personal, non-transferable, and may be amended or discontinued at any time unless already granted.
6. Cancellation and Refunds
6.1. Participants may cancel a course, workshop, bootcamp, or event free of charge up to twenty-four (24) hours before the scheduled start.
6.2. Cancellation within twenty-four (24) hours of the scheduled start may result in partial or complete forfeiture of the participation fee.
6.3. Once a course, workshop, bootcamp, or event has commenced, fees are generally non-refundable except where required by law or where otherwise agreed by Kizomba Evolution.
6.4. Participants who are unable to continue due to injury or medical circumstances may request a refund, credit, transfer, or alternative solution upon providing reasonable supporting information.
6.5. Approved refunds will normally be processed within fourteen (14) days.
7. Missed Classes
7.1. Participants who cannot attend a scheduled class are encouraged to notify Kizomba Evolution as soon as reasonably possible.
7.2. Missed classes do not automatically entitle a participant to a refund.
7.3. Where possible, Kizomba Evolution may offer a make-up class, course credit, reduced fee adjustment, transfer, or other solution at its discretion.
7.4. Any alternative arrangement offered by Kizomba Evolution is a goodwill accommodation and does not create an ongoing entitlement.
8. Cancellation by Kizomba Evolution
8.1. Kizomba Evolution may cancel, postpone, relocate, substitute teachers, adjust schedules, or modify activities where reasonably necessary.
8.2. Courses, workshops, bootcamps, or events may be cancelled due to insufficient registrations, venue issues, illness, force majeure, or other reasonable circumstances.
8.3. Where Kizomba Evolution cancels an activity, participants will receive either a suitable alternative, credit, transfer, or proportional refund.
9. Photography, Video, and Media
9.1. Kizomba Evolution may take photographs and video recordings during classes, socials, workshops, bootcamps, and events.
9.2. Such photographs and recordings may be used for educational, promotional, marketing, community-building, website, social media, and business purposes.
9.3. Participants who do not wish to appear in photographs or recordings should notify Kizomba Evolution in advance or as soon as reasonably possible.
9.4. Kizomba Evolution will make reasonable efforts to respect such requests.
9.5. Participants acknowledge that complete exclusion from group recordings may not always be possible during public or group activities.
10. Recording by Participants
10.1. Short recap videos, social dancing videos, and recordings expressly permitted by teachers may be made.
10.2. Recording of substantial portions of classes, complete lessons, teaching methodology, or educational content may be restricted or prohibited by Kizomba Evolution.
10.3. Participants may not publish, distribute, sell, license, or commercially exploit educational content, choreography, class material, or recordings without prior written permission.
11. Intellectual Property
11.1. All branding, logos, course materials, teaching methods, educational content, choreography, written materials, videos, graphics, and related content remain the intellectual property of Kizomba Evolution or its licensors.
11.2. Such materials may not be reproduced, copied, distributed, taught commercially, adapted, published, or exploited without prior written consent except where permitted by law.
12. WhatsApp Groups and Communication Channels
12.1. Kizomba Evolution may operate WhatsApp groups and other communication channels for participants.
12.2. Participation in such groups is voluntary.
12.3. Participants acknowledge that their phone number, profile information, and messages may be visible to other members of the group.
12.4. Spam, harassment, unwanted solicitation, repeated private messaging, inappropriate conduct, and promotion of competing dance schools, classes, events, or businesses are prohibited.
12.5. Participants who are no longer actively involved may be removed from communication groups.
12.6. Kizomba Evolution may remove participants from communication groups at its discretion where necessary to maintain a safe, productive, and respectful environment.
13. Promotion of Competing Activities
13.1. Promotion, advertising, solicitation, recruitment, or marketing of competing dance schools, classes, workshops, events, or businesses during Kizomba Evolution activities is prohibited without prior written permission.
13.2. Repeated violations may result in removal from activities and future registrations.
14. Liability
14.1. Dance and physical activities involve inherent risks.
14.2. Participation takes place at the participant's own responsibility and risk.
14.3. Kizomba Evolution shall only be liable for damages resulting directly from intent or gross negligence on the part of Kizomba Evolution, except where liability cannot legally be excluded or limited.
14.4. Nothing in these Terms excludes rights that participants are entitled to under mandatory law.
15. Property Damage
15.1. Participants may be held responsible for damage caused through unlawful, reckless, intentional, or negligent conduct.
15.2. Theft, vandalism, or intentional damage may be reported to the appropriate authorities.
16. Privacy
16.1. Personal data is processed in accordance with applicable Dutch and European privacy legislation, including the General Data Protection Regulation (GDPR).
16.2. Additional information regarding personal data processing can be found in the Privacy Policy published by Kizomba Evolution.
17. Age Requirements
17.1. Participants must be at least eighteen (18) years old unless permission has been provided by a parent or legal guardian.
18. Complaints
18.1. Complaints should be submitted within a reasonable period after the relevant incident.
18.2. Complaints may be submitted by email or through official communication channels provided by Kizomba Evolution.
18.3. Kizomba Evolution will make reasonable efforts to respond within fourteen (14) days.
19. Force Majeure
19.1. Kizomba Evolution shall not be liable for delays, interruptions, cancellations, or failures resulting from circumstances beyond its reasonable control, including force majeure as referred to in Article 6:75 of the Dutch Civil Code.
20. Governing Law and Jurisdiction
20.1. These Terms and Conditions are governed by Dutch law.
20.2. Any disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer protection law provides otherwise.
21. Amendments
21.1. Kizomba Evolution may amend these Terms and Conditions from time to time.
21.2. Amendments shall apply only to future agreements and future registrations.
21.3. The most recent version shall be published on the official website.
