Terms and Conditions for Participation with Kizomba Evolution

These Terms and Conditions apply to all participants, students, visitors, and users of the website and services of Kizomba Evolution.

By accessing our website, registering for classes, attending lessons or events, or otherwise making use of our services, you enter into an agreement with Kizomba Evolution and agree to these Terms.

1. General Obligations of Participants

1.1. Participants shall comply with all reasonable rules, guidelines, and instructions issued by teachers, staff, or organizers of Kizomba Evolution that are necessary for safety, order, and the proper conduct of classes and events.

1.2. Participation in classes, events, or activities organised by Kizomba Evolution is at the participant’s own responsibility and risk, taking into account the nature of physical movement involved in dance.

1.3. Dance activities involve inherent physical risks. Kizomba Evolution is not liable for damage or injury suffered by participants, unless such damage is the direct result of intent or gross negligence on the part of Kizomba Evolution.

1.4. Participants remain responsible for their personal belongings. Kizomba Evolution is not liable for loss, theft, or damage to personal property, except where mandatory law provides otherwise.

1.5. The use of wardrobes, lockers, or unsecured storage areas is at the participant’s own risk.

1.6. Theft, vandalism, or intentional damage occurring at any location where Kizomba Evolution provides services may be reported to the appropriate authorities.

1.7. A participant who causes damage to property or injury to staff or other participants through unlawful or negligent conduct may be held liable in accordance with Dutch law.

2. Use of Devices and Media Rights

2.1. The use of mobile phones, cameras, or other recording devices during classes is not permitted without prior consent from a teacher or staff member.

2.2. Photos and videos taken by or on behalf of Kizomba Evolution during classes or events may be used for marketing and promotional purposes.

2.3. Participants who do not wish to appear in photos or videos must notify Kizomba Evolution in writing prior to the class or event. This preference will be respected where reasonably possible.

3. Course Enrollment and Payment Terms

3.1. Enrollment in courses offered by Kizomba Evolution is completed by submitting the registration form via the official website: www.kizombaevolution.nl.

3.2. Kizomba Evolution may refuse or cancel a registration only on reasonable grounds, such as capacity limits, safety concerns, or violation of these Terms.

3.3. Course fees must be paid using the payment methods communicated by Kizomba Evolution, such as payment links or cash.

3.4. Unless otherwise agreed, course fees must be paid in full before the start of the course.

3.5. Participants who introduce two (2) or more new students who register and pay for a full course may receive a €5 discount on their own course fee for a maximum of two consecutive months, subject to availability and confirmation by Kizomba Evolution.

3.6. Participation in classes is subject to the approval of a teacher to ensure appropriate level placement and safety.

3.7. Discounts are personal, non-transferable, and apply only to the specific agreement for which they are granted.

4. WhatsApp Groups and Communication

4.1. Kizomba Evolution may maintain WhatsApp groups for participants who are actively enrolled in a course.

4.2. Participation in WhatsApp groups is voluntary and subject to approval by Kizomba Evolution.

4.3. Participants who do not continue with a subsequent course may be removed from the WhatsApp group at the start of the new course cycle and may be re-added upon re-enrollment.

4.4. WhatsApp groups are considered an extension of the learning environment. Participants are expected to communicate respectfully and appropriately.

4.5. In cases of serious or repeated misconduct, Kizomba Evolution may remove a participant from communication groups or classes, in accordance with proportionality and Dutch law.

5. Cancellation and Refund Policy

5.1. Participants may cancel a course free of charge up to 24 hours before the official start date and time of the course.

5.2. In the event of cancellation between 24 and 12 hours before the start of the course, Kizomba Evolution is entitled to charge 50% of the course fee as reasonable compensation.

5.3. Cancellation within 12 hours before the start of the course may result in no refund, unless mandatory consumer law provides otherwise.

5.4. In cases of medical cancellation, a refund may be granted upon presentation of reasonable proof.

5.5. Once a course has started, no refunds will be issued for unused classes, unless otherwise required by mandatory law.

5.6. Approved refunds will be processed within 14 days.

6. Missed Classes and Class Cancellations

6.1. Participants who are unable to attend a scheduled class should inform the teacher(s) at least 24 hours in advance.

6.2. Missed classes do not entitle the participant to a refund or replacement lesson, unless otherwise agreed.

6.3. Kizomba Evolution may cancel or reschedule classes or events due to unforeseen or unavoidable circumstances.

6.4. If Kizomba Evolution cancels a class or course, participants are entitled to a proportional refund or credit, unless an alternative is offered and accepted.

6.5. Participation may be suspended if payment obligations are not fulfilled, after reasonable notice.

7. Behavioral Expectations and Termination

7.1. Participants are expected to behave respectfully towards teachers, staff, and fellow participants at all times.

7.2. Kizomba Evolution may suspend or terminate participation only in cases of serious misconduct or repeated violations of these Terms, and only where such measures are reasonable and proportionate.

8. Marketing Restrictions and Intellectual Property

8.1. Promotion of competing dance schools or events during classes or events of Kizomba Evolution is not permitted without prior consent.

8.2. All educational materials, choreography, branding, and content remain the intellectual property of Kizomba Evolution and may not be reproduced or distributed without written permission, except where permitted by law.

9. Complaints Procedure

9.1. Complaints should be submitted within a reasonable time after the incident, preferably within 14 days, via email to kizombaevolution@gmail.com or via the contact form on www.kizombaevolution.nl.

9.2. Kizomba Evolution will respond in writing within 14 days of receiving the complaint.

9.3. Complaints will be handled confidentially and without adverse consequences for the complainant.

10. Privacy and Data Protection

10.1. Personal data is processed in accordance with applicable Dutch and European data protection laws, including the General Data Protection Regulation (GDPR).

11. Age Requirements

11.1. Participation is open to individuals aged 18 or older, unless written consent is provided by a parent or legal guardian.

12. Force Majeure

12.1. Kizomba Evolution is not liable for failure or delay in performance due to circumstances beyond its reasonable control, in accordance with Article 6:75 of the Dutch Civil Code.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by Dutch law.

13.2. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

14. Amendments to These Terms

14.1. Kizomba Evolution may amend these Terms from time to time.

14.2. Amendments will apply only to future agreements. The most recent version will be published on the website.
